Do I have to withhold taxes from my nanny if I call her an independent contractor?

Yes. The IRS considers virtually any nanny (or other person) that works in your home to be a household “employee”, and not an independent contractor, no matter how you label them. You are responsible to withhold and pay certain federal employment taxes for all your household employees.
